PURCHASE RULES
ELEVITA online store www.elevita.lt rules:
1. General provisions
1.1. These rules for the purchase and sale of goods (hereinafter referred to as the "Rules"), after their approval by the Buyer (by checking the box when purchasing goods that you agree to the "elevita.lt" rules), are a legal document binding on the parties, which establishes the rights and obligations of the Buyer and the Seller, the terms of purchase and payment for goods, the procedure for delivery and return of goods, the liability of the parties and other provisions related to the purchase and sale of goods in the "elevita.lt" online store.
1.2. The Seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by law.
2. Personal data protection
2.1. Any information related to personal data and which is registered in "elevita.lt" is considered confidential and not made public.
3. Buyer's rights
3.1. The Buyer has the right to purchase goods in the "elevita.lt" online store in accordance with the procedure established by these Rules.
3.2. The Buyer has the right to withdraw from the contract of purchase and sale of goods concluded with the "elevita.lt" online store by notifying the Seller in writing (by e-mail, indicating the desired product to be returned and the order number) in accordance with the procedure established by these Rules.
3.3. The Buyer has the right to exchange or return the purchased goods in accordance with the procedure established by the Rules.
4. Buyer's obligations
4.1. The Buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.
4.2. The Buyer must correctly indicate his contact details.
4.3. The Buyer must inform the Seller about any changes in contact details, payment or delivery method. Otherwise, the Seller is not responsible for a delayed shipment due to a change in these matters.
5. Seller's rights
5.1. The Seller has the right to cancel the Buyer's order without prior notice if the Buyer, having chosen the payment method specified in clause 7.3.1. of the Rules, does not pay for the goods within 3 (three) days.
6. Seller's obligations
6.1. The Seller undertakes to respect the Buyer's right to privacy to personal information belonging to him, specified in the registration form of the online shopping center.
6.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him under the conditions specified in clause 10 of the Rules.
6.3. If the Seller is unable to deliver the ordered goods to the Buyer due to important circumstances, he undertakes to offer an analogous or as similar product as possible in terms of its characteristics. If the Buyer refuses to accept an analogous or as similar product in terms of its characteristics, the Seller undertakes to return the money paid to the Buyer within 5 (five) business days, if an advance payment was made.
7. Prices of goods, payment procedure and terms
7.1. Prices of goods in the online store and in the formed order are indicated in euros including VAT.
7.2. The order amount must be at least 10 EUR.
7.3. The Buyer pays for the goods in the following way:
7.3.1. Payment by bank transfer.
7.3.2. Payment through the Paysera.lt system, when the Buyer, having chosen the desired bank, pays money to the Elevita bank account.
7.4. When paying by the payment method provided for in paragraph 7.3.1., the Buyer undertakes to pay immediately. In the above cases, taking into account the Seller's right provided for in paragraph 5.1. of the Rules, only upon receipt of payment for the goods shall the parcel of goods be formed and the delivery term of the goods be calculated.
8. Loyalty program and Rules for the use of loyalty points
8.1. The Program Participant can use the Benefits only if he/she makes a purchase in the e-store, after registering and logging in to his/her account.
8.2. Purchasing in the e-store, after logging in to his/her account, ensures that the Program Participant will receive and accumulate Points for each item whose price is equal to or exceeds 5 euros. 5 euros are equivalent to 1 loyalty point.
8.3. Loyalty points are not assigned for transportation services.
8.4. The Program Participant can use the Points accumulated in the account when shopping in the e-store, after logging in to his/her account. Points are activated within one business day after order confirmation. Points can be used to pay for up to 30% of the purchase amount. 1 loyalty point is equal to 0.25 euros. Loyalty points are not valid for discounted items.
8.5. The validity period of the accumulated Points is 12 months. Points that were accumulated first are used first when paying for the purchase.
9. Discount System and Use of Discount Coupons
9.1. Discount codes can only be used after registering for your account.
9.2. Discount codes are valid for goods that are not on sale or on sale at that time.
9.3. Discounts are not cumulative.
9.4. When applying a discount code to the shopping cart, discounts will be calculated only for goods without a discount, and are not calculated for transportation services.
9.5. If a discount code is not used for a specific order and paid for, it is not possible to apply the code to the same order later.
10. Delivery of Goods
10.1. When ordering goods, the buyer undertakes to specify the exact place (address) of delivery of goods and a contact phone number where the courier could deliver the goods on weekdays between 8 am and 5 pm. and at which the Buyer can be reached.
10.2. The Buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to an inappropriate entity.
10.3. The goods are delivered by the Seller or his authorized representative.
10.4. In exceptional cases, the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control, which the Seller could not control and reasonably foresee at the time of concluding the purchase and sale agreement. In such a case, the Seller undertakes to immediately contact the Buyer and agree on the terms of delivery of the goods and other conditions. If the Buyer expresses his disagreement to wait, he has the right, pursuant to C. K. 6.359 Art.4d. to terminate the contract and recover (as soon as possible) the money paid.
10.5. In all cases, the Seller is exempted from liability for violation of the delivery terms of the goods if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the control of the Buyer.
10.6. During the delivery of the goods, the Buyer must check the condition of the shipment together with the Seller or his authorized representative. After the Buyer signs the invoice (waybill) or other document of delivery and acceptance of the shipment, it is considered that the shipment has been transferred in proper condition. Having noticed that the packaging of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the Buyer must note this on the invoice (waybill) or other document of delivery and acceptance of the shipment and, in the presence of the Seller or his representative, draw up a free-form act of damage to the shipment. If the Buyer fails to perform these actions, the Seller is released from liability to the Buyer for any damage to the goods that the Buyer has not noted in the manner prescribed above.
10.7. If the Buyer fails to collect the goods within the specified time or fails to deliver them to the Buyer due to his fault and the Buyer has paid for the goods and their delivery, the Seller will contact the Buyer regarding another time and/or method of delivery of the goods. If the Buyer still fails to collect the goods or fails to deliver them, such goods will be returned to the Seller, the order will be cancelled, and the money paid for the goods will be returned to the Buyer, after deducting the delivery fee, if applicable.
11. Quality guarantee and shelf life of the goods
11.1. The properties of each product sold on eshop.elevita.lt are indicated in the description of each product.
11.2. The Seller is not responsible for the fact that the color, packaging size, shape or appearance of the Goods shown in the photos of the Goods presented in the online store, as well as the smell, texture or other properties of the Goods, attributed to the Goods due to the image settings of the technical equipment used by the Buyer or the Buyer's subjective assessment, may slightly differ from the actual corresponding properties of the Goods. The Buyer is recommended to read the description of the goods.
11.3. The Seller is not responsible for changes in the properties of the Goods that may occur due to temperature changes or other circumstances beyond the Seller's control when delivering the Goods to the Buyer.
12. Return and exchange of goods
12.1. The right to withdraw from the purchase and sale agreement:
12.1.1. The Buyer, without giving a reason, has the right to withdraw from the contract of sale of goods within 14 (fourteen) days by notifying the Seller thereof. The Buyer cannot exercise this right after concluding one of the contracts listed in Article 6.22810, Part 2 of the Civil Code of the Republic of Lithuania.
12.1.2. The Buyer shall notify the Seller of the withdrawal from the contract of sale in one of the following ways: by filling out the contract withdrawal form or by submitting a clear statement setting out his decision to withdraw from the contract. The notification of withdrawal from the contract shall be sent by e-mail to eshop@elevita.lt. Upon receipt of the Buyer's notification, the Seller shall inform the Buyer of the receipt of the notification.
12.1.3. The 14 (fourteen) day period provided for exercising the right to withdraw from the contract of sale is calculated as follows:
12.1.3.1. when concluding a contract of sale, - from the day on which the Buyer receives the ordered goods;
12.1.3.2. if the Buyer has ordered more than one item in one order and the items are delivered separately, - from the day the Buyer receives the Seller's item.
12.1.4. If the Buyer has withdrawn from the purchase and sale agreement before the item has been delivered to him, the Buyer must inform him about this via the contacts specified on the eshop.elevita.lt website. The Buyer's withdrawal is formalized as a cancellation of the order.
12.1.5. If the Buyer has withdrawn from the purchase and sale agreement after the item has already been delivered or he has collected it, the provisions of clause 12.3. of the Rules apply.
12.2. The Buyer has the right to replace the purchased goods with similar goods of different dimensions, shape, color, model or completeness within 14 (fourteen) days from the date of transfer of the goods to him. If a price difference occurs when replacing the goods, the Buyer must settle with the Seller according to the recalculated prices. The Buyer's notification of the desire to exercise the right provided for in this clause of the Rules with the specified returned goods shall be sent by e-mail to eshop@elevita.lt.
12.3. If the Buyer does not like the shape, size, color, model or completeness of the purchased goods, the goods shall be returned in accordance with Article 6.22810 of the Civil Code of the Republic of Lithuania. The Buyer must ensure that the quality, packaging and compliance with safety and hygiene requirements of the returned Goods do not change.
12.3.1. The Buyer does not have the right to withdraw from the purchase and sale agreement and return the following Goods to the Seller:
- Pharmaceutical preparations;
- quality goods that the Buyer has used, damaged, damaged their packaging or due to other actions taken by the Buyer, the goods have lost their commercial appearance and are unsuitable for return due to hygiene or health protection;
- other goods that the Seller has the right to refuse to accept in accordance with applicable legal acts.
12.3.2. In accordance with Article 6.22811 of the Civil Code of the Republic of Lithuania, the Buyer is liable only for the decrease in the value of the goods that has occurred due to actions that are not necessary to determine the nature, properties and operation of the goods.
12.4. The Buyer has the right to exercise the right to return all Goods purchased during a single purchase and to recover the money paid for all Goods and their delivery or to refuse part of the Goods purchased during a single purchase and to recover the money for the Goods that the Buyer refuses.
12.5. If the Buyer has purchased a cosmetic or hygiene product or a food product of inadequate quality, the Buyer has the right to return such a product in accordance with Article 6.3641 of the Civil Code of the Republic of Lithuania.
12.6. When returning the goods, the Buyer must indicate the sender's address and properly pack the product so that it is not damaged during shipping. The product is considered properly packed when it is placed in additional outer packaging (placed in a box, bag, wrapped in paper, etc.) and this packaging is tightly closed (for example, taped). If the returned goods are fragile or fragile, they must be additionally protected from impacts by wrapping them in several layers of paper, cloth or bubble wrap and then placed in the outer packaging of the parcel (box, bag, paper). The Seller is not responsible for parcels that were sent by the Buyer in an improperly packaged manner, with an incorrect address, as well as if the parcels were lost or damaged during the return to the Seller.
12.7. The Buyer can return the Goods by delivering them directly to the branded stores of UAB "Elevita". The Buyer can separately agree on the conditions with the Seller by phone or e-mail eshop@elevita.lt.
12.8. It is also possible to return the goods via omniva parcel machines. How to return the store's https://eshop.elevita.lt parcels via Omniva parcel machines:
1. Fill out the goods return form: Omniva returns
2. Pack the returned goods and place them in the Omniva parcel machine.
3. Money for returned goods is transferred within 10 business days from the time the goods are delivered to the e-store eshop@elevita.lt
Requirements for returned packaging: not less than 2x9x14 cm and not more than 38x64x39cm. Maximum weight of the returned shipment: 30 kg.
12.9. Money for returned Goods is returned to the Buyer only by bank transfer to the Buyer's bank account, regardless of whether the Buyer paid for the Goods by bank transfer or in cash. The Seller does not make payments in cash.
13. Liability
13.1. The Buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences arising therefrom.
13.2. The registered Buyer is responsible for the storage and/or transfer of his/her login data to third parties. If the services provided by elevita.lt are used by a third party who has logged in to elevita.lt using the Buyer's login data, the Seller considers this person to be the Buyer.
13.3. The Seller is exempted from any liability in cases where losses arise due to the fact that the Buyer, disregarding the Seller's recommendations and his/her obligations, did not familiarize himself/herself with these Rules, although he/she was given such an opportunity.
13.4. In the event of damage, the guilty party shall compensate the other party for direct losses.
14. Final provisions
14.1. These rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
14.2. The law of the Republic of Lithuania applies to relations arising on the basis of these rules.
14.3. All disagreements arising from the implementation of these rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania. In the event that the Buyer does not agree with the response prepared by the Seller and transmitted to eshop.elevita.lt to the Buyer's written claim, the Buyer (natural person, consumer) may submit his request/complaint regarding the goods purchased from the Seller via eshop.elevita.lt to the State Consumer Rights Protection Service (Vilniaus g. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, tel. 85 262 67 51, fax: (85) 279 1466, on the website www.vvtat.lt (also to the territorial divisions of the State Consumer Rights Protection Service in the counties) - or fill out the request form on the ODR platform https://ec.europa.eu/odr/.
